2016? Colorado governor in the mix (Politico)

DENVER ? A popular Democratic swing-state governor who brags unprompted about annoying a key liberal constituency and has a background as a small business owner might have a run for national office in his future.

Colorado Gov. John Hickenlooper, who founded a brewpub and was twice elected Denver?s mayor, cruised to victory in 2010 in a three-way race against a fractured state Republican Party. He registered a 54 percent approval rating in a Public Policy Polling survey earlier this month, a whopping 30 percentage points higher than his 24 percent disapproval.

?I would say that nothing John Hickenlooper does or how high he climbs surprises me,? said Denver political consultant Eric Sondermann. ?He?s really someone who has always looked at one league up. ? As governor, I think he is thinking, ?I?m good enough to play in that league.??

And Hickenlooper, while disavowing national ambitions as all potential candidates do this early in the 2016 cycle, speaks the language of a Democrat laying a long-term path toward a national political profile.

?You never say never, but it?s hard to imagine,? Hickenlooper told POLITICO in an interview in his state Capitol office here. ?What we?re trying to do here necessarily, I think, is going to irritate and I think in some ways divide some of the strongest constituencies that are going to be making those decisions.?

Hickenlooper?s best path to national office in 2016 would come in a Democratic Party looking for a centrist leader in the mold of President Bill Clinton, said University of Wisconsin political science professor Charles Franklin.

?Under many circumstances, Hickenlooper would represent a Democrat with crossover appeal who can win in swing states,? Franklin said.

Hickenlooper described his platform in Colorado as one that can be emulated nationwide.

?In terms of all kinds of things, in terms of educational reform, in terms of health care, transportation, Colorado has a chance to be a national model,? he said. ?But the moment a governor in a state starts thinking in terms of what their political prospects would look like for some national office, the moment you do that you lose your ability to do stuff you really want to get done.?

He added: ?The moment you begin thinking, even allowing that (national office) into your thought, of how would that play on a national stage, how would the environmental constituency play, you?re toast.?

But in a move is would lead to an increased national profile, Hickenlooper and Denver Mayor Hancock are to meet this week to discuss forming a committee to explore bidding for the 2022 Winter Olympics, Denver Fox affiliate KDVR reported.

Hickenlooper?s approval rating in the PPP survey, conducted from Aug. 4-7, prompted his hometown Denver Post to remark that his work is ?creating whispers about a potential path toward the White House in 2016.?

And despite Hickenlooper?s suggestion that his support for hydraulic fracking will make him toxic among liberals, his numbers among home-state Democrats ? 78 percent approval, 12 percent disapproval ? are better than those of that other first-year Democratic governor with sky-high approval ratings who has spent much of this his first months in office surrounded by 2016 buzz.

Gaddafi stronghold under threat from air and land (Reuters)

TRIPOLI (Reuters) ? NATO warplanes bombed Muammar Gaddafi's hometown of Sirte on Sunday as forces opposed to the fallen strongman closed in on his last major bastion of support.

The fugitive Gaddafi's exact whereabouts where still not known and it was possible he was still in hiding in Tripoli five days after it fell to rebel forces and his 42-year-old reign collapsed.

In the capital, the rebel leadership sought to establish control after days of confusion and sporadic skirmishing with the remnants of Gaddafi's forces.

But the stench of rotting bodies and burning garbage still hung over the city and food, water and other supplies were running short, indications that despite the euphoria of victory, plenty of challenges lay ahead.

A NATO spokesman in Brussels said that foreign warplanes -- which have played a crucial role in backing the rebels during the six-month civil war -- had struck at Sirte over the past three days including Sunday.

"We're paying close attention to what's happening in Sirte because we know that there are remnants of the regime that are there," he said.

Libyan forces also closed in Sirte, Gaddafi's birthplace, from the ground and said they would seize it by force if negotiations for its surrender failed.

One commander said his forces were within 100 km (60 miles) of Sirte from the east and others were advancing from the west.

Reuters reporter Maria Golovnina, traveling east from Tripoli along the coastal highway, saw tank transporters carrying Soviet-designed T-55 tanks in the direction of Sirte.

Rebels in Misrata, about 250 km west of Sirte, said they had seized about 150 brand new Gaddafi tanks from an abandoned military base in Zlitan and were preparing to deploy them if Gaddafi supporters in Sirte did not surrender.

Jamal Tunally, a rebel military commander in Misrata, told Reuters: "The front line is 30 km from Sirte. We think the Sirte situation will be resolved peacefully, God willing."

"Now we just need to find Gaddafi. I think he is still hiding underneath Bab al-Aziziyah like a rat," said Tunally, referring to Gaddafi's compound in Tripoli which was overrun by rebels on Tuesday.

Colonel Ahmed Bani, military spokesman of the National Transitional Council (NTC) in the eastern city of Benghazi, said the negotiations over Sirte would go on as long as necessary but either way it would liberated in "a matter of days."

Gaddafi, 69, is on the run and the fear among his foes is that he intends to lead an insurgency against them.

NTC officials also rejected any idea of talks with Gaddafi, saying he was a criminal who must be brought to justice.

"We did not negotiate when we were weak, and we won't negotiate now that we have liberated all of Libya," NTC information minister Mahmoud Shammam told a news conference.

The Associated Press earlier quoted Gaddafi's spokesman, Moussa Ibrahim, as saying Gaddafi was still in Libya and wanted to discuss forming a transitional government with the NTC.

NTC officials say Gaddafi, his son Saif al-Islam and his spy chief should be tried in Libya, although they are wanted by the International Criminal Court for crimes against humanity.

The NTC and its Western backers are acutely aware of the need to prevent Libya collapsing into the kind of chaos that plagued Iraq for years after the U.S.-led invasion of 2003.

The de facto government, whose leaders plan to move to Tripoli from Benghazi this week, is trying to impose security, restore basic services and revive the energy--based economy.

But in the aftermath of victory, many corpses have been found, some of slain Gaddafi soldiers, others the victims of killings in cold blood.

A Libyan official said 75 bodies had been found at the Abu Salim hospital, which was caught up in heavy fighting, and another 35 corpses were found at the Yurmuk hospital.

The possibility that rebel fighters executed captured Gaddafi soldiers would pose an image problem for the NTC.

Military spokesman Bani said there was concern for the fate of 40,000 prisoners who he said had been detained by Gaddafi's forces and who were still unaccounted for. It was possible some were being held in underground bunkers in Tripoli that rebels had so far been unable to locate, he said.

GOOD OMENS

In good omens for economic recovery, officials said a vital gas export pipeline to Europe had been repaired and Libya's biggest refinery had survived the war intact.

In the west, Tunisian authorities reopened the main border crossing into Libya, restoring a supply route for Tripoli, after Gaddafi forces were driven out on Friday.

That should help relieve a looming humanitarian crisis in the city, where food, drinking water and medicines are scarce.

Trucks loaded with food and other goods were already moving across the Ras Jdir crossing toward Tripoli, about two hours' drive away.

The streets of the capital were quiet after sporadic overnight gunfire and explosions in a city.

Some residents ventured out to hunt for water, food and fuel. And in Martyrs' Square, known as Green Square in the Gaddafi era, traffic police reappeared in crisp white uniforms, directing cars amid a sea of bullet casings.

"I came back to work on Friday. Life is beginning to come back to normal," said one policeman, Mahmoud al-Majbary, 49."

Tripoli residents queued for bread or scoured grocery shops for food. Many took a stoical view of their plight.

"This is a tax we pay for our freedom," said Sanusi Idhan, a lawyer waiting to buy food.

Aymen Mohammed poured water into plastic containers for his neighbors. "There are many people here who don't have water so we're filling the bottles from our well," he said.

The NTC issued messages urging electricity workers to get back to work and efforts to pay the salaries of public sector workers were underway.

The NTC hopes to gain access soon to hundreds of millions of dollars of Libyan assets frozen abroad. It also needs to get oil and gas revenue, normally 95 percent of exports, flowing again.

Bani said the gas pipeline to Europe had been repaired and gas woulod start flowing again soon, he said.

Libya's largest oil refinery at Ras Lanuf on the Mediterranean coast is intact despite fighting that had raged nearby and staff are preparing to restart operations at the 220,000 barrel per day plant, the general manager told Reuters.

US should raise taxes to help fix deficits, say business economists (The Christian Science Monitor)

At a time when Republicans in Congress are digging in their heels against raising more federal tax revenue, private-sector economists are sending an opposite signal in a new poll.

Some three-quarters of economists who do forecasting for the private sector say tax revenue should rise as part of efforts to tame unsustainable budget deficits, according to the survey released Monday by the National Association for Business Economics (NABE).

By contrast, 19 percent said tax reform should be done in a "revenue-neutral" way, and 5 percent said reforms should reduce tax revenues. About 250 business economists participated in the NABE survey.

RECOMMENDED: Federal budget mess: Six ways to fix it

In recent high-stakes negotiations in Congress to raise the national debt limit and reduce future US deficits, most Republican lawmakers said they will not support deficit-reduction plans that raise new tax revenue. The fix, they argue, should come wholly through spending cuts.

By contrast, the economists in the NABE survey, conducted the two weeks just before Washington's Aug. 2 achievement of a debt deal, took a more complex and centrist view of the nation's fiscal problems. While many of them favored spending cuts, a majority argued that the challenge of federal deficits stems from low tax revenue and the recession's after-effects, as well as from untamed spending habits.

That helps explain why many economists support the idea of tax reform that enhances federal revenues ? as was also favored by President Obama's bipartisan fiscal commission. Among survey respondents who wanted to see both spending cuts and tax increases, 44 percent preferred a package based primarily on spending cuts, according to Monday's NABE report. Some 37 percent said fiscal reforms should use equal parts spending cuts and tax increases.

Many finance experts have argued in recent months that tax reform could be pursued in a way that simplifies the tax code and keeps rates low ? perhaps even reducing some tax rates ? while also raising more revenue by closing loopholes and reducing deductions.

But some economists worry that efforts to expand tax revenue in the near term, or to cut federal spending too fast, could damage a weak economic recovery. Nearly 37 percent of the economists said fiscal policy should aim to provide more stimulus to the economy in the next two years, rather than less (as would occur with tax hikes or spending cuts).

Although most of the economists tipped against the Republican Party's argument on tax revenues, they also appeared to contrast with Democrats on some issues. Asked what steps would most likely help reduce future deficits, the most popular choice in the survey (selected by 40 percent of respondents) was "contain health care costs in Medicare and Medicaid." In the recent debt talks, many Democrats opposed proposals that would reduce those entitlement benefits.

On Federal Reserve policy, most of the economists said current Fed policy is "about right," while about one-third argued that the Fed is being too loose, or stimulative. Six percent see the Fed as too restrictive.

For his part, Mr. Obama has said he is open to deficit-reduction plans that emphasize spending cuts over tax hikes. He has proposed that more tax revenue be raised primarily from the highest-income Americans.

The large percentage of survey voices supporting higher tax revenues may be surprising, but it's also a reminder that finance experts see the difficult fiscal choices ahead, often involving trade-offs between unpopular program cuts and unpopular tax hikes.

Also, although some business groups support generally conservative economic policies, members of the economics profession are politically diverse in their views.

Headaches are a difficult thing to deal with. They seem to come on for many different reasons. Tom Hardy: Leaked 'Dark Knight Rises' Photos 'Bear Very Little Resemblance To What's Going On' (omg!)

LOS ANGELES, Calif. -- In recent weeks, dozens of photographs from the Pittsburgh set of "The Dark Knight Rises" have cropped up on the internet, but Tom Hardy, who plays Batman villain Bane in the project, isn't worried the early un-authorized looks at the project will hurt director Christopher Nolan's vision.

"No, I don't think so," Tom told Access Hollywood on Saturday as he promoted his newest box office feature, the Mixed Marital Arts-themed "Warrior," in Beverly Hills.

"I think there's a certain inevitability if you're going to shoot in the middle of the street -- that it's very hard to block off the entire street from people taking photographs," Tom continued. "But that doesn't mean it's going to be anything like the film. You have people taking photographs from a distance of what's going on on the ground. It bears very little resemblance to what's going on."

Tom's "Warrior" co-star, Joel Edgerton, who is getting ready for his own highly anticipated project, "The Great Gatsby," suggested the Internet postings only add to the excitement.

"It all becomes enticing, doesn't it, I think, for everybody?" Tom chimed in. "The Internet helps, the fans help the film anyway, it all becomes enticing. You just get little grabs, and people are like, 'I wanna know more!'"

One thing plenty of movie fans want to know more about presently is the physiques Tom and Joel achieved for their brothers-at-odds drama "Warrior," which - in the film's poster -- shows both men ripped like superheroes.

If Joel had listened to the advice of one physician, however, he wouldn't have signed on for the role of Brendan Conlon, a physics teacher, father to two daughters and a husband to Jennifer Morrison's Tess Conlon, who turns to life in the brutal MMA ring in hopes of saving his family from total financial ruin.

"I have a couple of neck issues, like most people on the planet," Joel, who practiced martial arts as a youngster in his native Australia, told Access. "I had this doctor say to me, 'I suggest that you do not do this movie.'"

"Really?" a surprised Tom chimed in.

"Yeah... Obviously I did it... He had fears for my neck. But that was part of the excitement for signing up for something like that," Joel continued. "It's a real challenge, because I had the sort of stupid idea that I was too old to do something that athletic any more - 'Martial arts for me is all gone,' which is absolutely stupid."

Tom, who plays the returned-from-Iraq Tommy Conlon in the film, Brendan's younger brother battling his own demons, said the help of trainers got him in shape, but while it was a painful project to film, he couldn't say no to the challenge of the role.

"It just hurts, doesn't it? I'm not gonna lie," the Brit said with a laugh of shooting the intense fight scenes. "It's MMA. It hurts. You either get better at it or you don't and you don't continue it."

"Warrior" hits theaters on September 9.

Tornado-stricken Joplin goes back to school (AP)

JOPLIN, MO. ? The trophy case by the front entrance is nearly empty. Classroom walls are largely bare, and unopened boxes of textbooks, computer monitors and other equipment remain scattered throughout the building.

Signs of unfinished business remain at what is now Joplin High's upper-level campus ? a converted big-box retail store at the city's mall, well outside the worst-hit areas from a late May tornado that killed 160 people, injured hundreds more and destroyed thousands of buildings, including the city's only public high school.

On Wednesday, as Joplin students and teachers went back to school less than three months after the country's single deadliest tornado in six decades cut the previous school year short, no one seemed to mind the shortcomings.

After months of hauling debris, attending friends' funerals, watching endless TV images of their destroyed school and trying to put their lives back together, it was finally time to get back to what passes for normal in Joplin.

"You can't pretend like nothing happened," said English teacher Brenda White. "But everything is so new here. Every single thing that is this school is new and different.

"It's going to take a while to build everything back, but books are a good start," she said while stocking her classrooms with copies of The Great Gatsby, The Kite Runner and other literary staples, past and present.

The school system was hit especially hard by the May 22 tornado. Seven students and one employee were among the victims, including a senior pulled from his car by vicious winds on his way home from Joplin High's Sunday afternoon graduation ceremony. Six school buildings were destroyed, including Joplin High. Seven other buildings were badly damaged.

School district leaders quickly realized that they would play an outsized role in Joplin's recovery, for reasons symbolic as much as practical. They expanded the hours and locations of summer school, well aware that the community's children needed a reassuring routine ? and their parents the time to deal with insurance agents, contractors and social service agencies.

They cobbled together a hodge-podge of temporary locations for fall classes, from the old Shopko store at Northpark Mall to the recently-vacated Missouri Department of Transportation district office where the superintendent and other administrators now work. Rival elementary schools combined, and a middle school found space in an industrial park.

Even in a corner of the country where hard work is cherished, the swiftness of the transformation was striking, White said.

"I've always known people are strong here. But this has really brought it home," she said. "People are so strong. They just get up, dust off and go to work. That's what we do here."

Students arrived at the "mall school" Wednesday morning to a bevy of well-wishers holding Joplin High signs and lining the entrance road. Some met in modular classrooms, right next to a row of concrete-lined storm shelters. Others lingered in the hallways, reuniting with old friends.

They raved about the school's college-like feel, complete with Joplin Joe's coffee bar and free laptops for each student thanks to a donation from the United Arab Emirates worth as much as $1 million.

Count their parents and adult relatives among the most impressed by the transformation.

"It just blows your mind," said Pamela Berry, who accompanied her 17-year-old nephew to a Tuesday night open house. "I want to come back to high school."

Missouri Gov. Jay Nixon, who toured the school Wednesday, encouraged students to take advantage of their new learning environment.

"I hope you use what has been given to you to lift the expectations of Joplin even higher," he said. "While there's been tremendous suffering, there are even greater expectations."

Among those hoping to match those expectations was junior Christopher Jones. Unlike most years, his summer vacation couldn't end soon enough, he said.

"I was really just looking for a change," Jones said.

School officials brought in additional counselors and trauma workers to help students and families who may still be struggling with the storm's aftermath.

"We can build buildings, but the emotional damage that this storm has caused is of a very significant concern and something we're going to be watching closely for months, if not years," Superintendent C.J. Huff said.

Phillip Gloyer, a communication arts teacher who is also a National Guard chaplain, said he plans to tap his divinity school training as well as his expertise in British literature.

"I'm just really focused on the kids' emotional health," he said. "A lot of hugs, a lot of encouragement. Asking them to tell their story. That's the best therapy."

Opinions, reason, and communication

A Christian Science perspective: Humility and respect can raise interactions to a new level.

Opinions, especially rigidly held ones, can get in the way of productive communication. On the other hand, keeping our own opinions open to reason and revision can do much to open up communication and move things forward in a productive direction. That doesn?t mean, however, that anyone should lose one?s bearings, become indecisive, and have no principle to stand up for.

The problem with opinions, though, is that they have no certainty of their own; they are inherently incomplete. They?re built only on what seems true according to one?s own knowledge and judgment. And when one regards his or her opinions as the right ones as opposed to others? wrong ones, little wiggle room is left for productive discussion. To break the stalemate, something ? human pride? ? has to give. The place to start is with oneself.

There is a certainty we can latch on to that enables us to feel anchored while at the same time respecting, listening to, and thoughtfully considering the views of others. This certainty is found in the only Mind whose wisdom is always right; that is the divine Mind, or God, the eternal Principle of the universe and man (the generic term for men, women, and children).

As the book of Job in the Bible says of God, ?He is in one mind, and who can turn him? and what his soul desireth, even that he doeth? (23:13). But God is not an arbitrary judge of human affairs. He is the governor of His own thoughts, or ideas, including each of us as His sons and daughters. We are each the reflection of His wisdom and love.

It helps me to realize that when a human being turns to God for wisdom, God does not say, literally, ?Think this way about that situation, or take this particular course of action in dealing with it.? No, the message God imparts to human consciousness is ?Remember that you ? and everyone else ? are my spiritual image and likeness, actually capable only of thoughts and actions that reflect my love and care for everyone.? This gives me an anchor upon which to consider fresh thinking on the subject at hand.

The following statement from the founder of the Monitor, Mary Baker Eddy, has always been a helpful guide for me: ?The one Mind, God, contains no mortal opinions? (?Science and Health with Key to the Scriptures,? p. 399). Accordingly, I endeavor not to form opinions but rather to have revisable viewpoints ? open to revision from wisdom on high. It?s a mental stance that goes something like this: ?From what I?ve observed, and from the knowledge at my disposal, things look this way, but I know that the wisdom of God is higher than mine. So I?ll keep my thought open to His guidance, which may come directly through prayer, or from what others share of their thoughts on the subject.?

While personal opinions, if not carefully watched, can morph one into being opinionated and therefore less considerate of others? views, divine wisdom can transform the human mind into a ground for healing. It?s comforting to realize that ?the wisdom from above is first pure, then peaceable, gentle, open to reason, full of mercy and good fruits, impartial and sincere? (James 3:17, English Standard Version).

Experience has shown me that when my own heart is fixed in a humble openness to God?s guidance, communication with others is most productive. It?s a quiet acknowledging and praising God, divine Love, as the only real governor of everyone involved. This enables me to curb any tendency to push my opinions or viewpoints and to respectfully listen to what others have to say ? while at the same time listening for God?s guidance of my thought. This takes discipline, to be sure, and it?s not always easy to do. And sometimes, regretfully, I forget to do it. But this mental stance is worth cherishing and putting into practice.

Because divine wisdom guides thought in the direction that blesses everyone, it?s always safe to have one?s heart fixed in prayer, instead of in human opinions. We can say with the Psalmist, ?My heart is fixed, O God, my heart is fixed: I will sing and give praise? (Ps. 57:7). Whether dealing with a personal relationship, working with others toward a productive decision in an organization, or conversing with others about political matters, one person?s openness to God?s guidance can bring the certainty of His healing love into the equation.

The Letter That Got My Homeowner's Insurance Company To Pay Up ...

Reader S finally got his homeowner's insurance company to pay up for the rebuilding of the glass railings around his condo, thanks to a well-crafted and scary letter he wrote them. Here is his story, and his ass-kicking letter.

Dear Consumerist,

I have been a long time reader and have found many of your entries very informative, educational and inspiring. I am emailing you today is to share a recent victory with my homeowner's insurance company.

The story begins with several instances of mysterious glass breakage on the glass balcony railings of our 5-year old condominium building. Ultimately the NYC Department of Buildings steps in and mandates that our condo must update all of the railings to conform to a recent revision of the building code. Our condo complies with this order and obtains partial compensation from the condo builder and the condo's master insurance company and then turns to the condo residents to foot the rest of the bill through a series of monthly special assessments. In turn, I submitted a claim online to my homeowner's insurance company because the fine print of the all-risk policy includes coverages relating to "unit assessments", "glass breakage" and requirements to "rebuild to code". I am probably one of the few people who actually reads the 60 page policy from cover to cover every year looking for these kinds of paragraphs.

My claim was handled quite fast, though the claim was denied several times as I continued to cite the relevant policy coverages and escalate the matter to more senior adjusters. Ultimately, after 4 months I receive a written letter denying coverage because "It appears [the damage] was due to possible faulty construction and deficiencies."

Inspired by articles I have read on Consumerist about taking large companies to small claims court, I started to conduct some research on how to sue in small claims court in NY, the legal issues involved with homeowner's policies and insurance policies in general. I learned that the costs to file in small claims court are low, the submissions can be done online and the amount of my claim wasn't too high for small claims court. I also learned that there is an extremely high burden of proof for insurers with "all-risk" policies and many legal precedents (and articles) to support this matter of law. In essence, the insurer has to prove that there was a construction defect, and I knew this was impossible for them to do (in fact, I had an engineer's report citing that the cause of the damage cannot be determined). Armed with all of this research, I drafted a letter (redacted form below) to my insurance adjusted citing the relevant matters of fact and related matters of law. I did not threaten to sue, but I am sure the tone of the letter made it obvious that would be the next step.

One day before the deadline in my letter, I got a phone call from the insurance adjuster saying that my claim was approved. This was a great victory for me, as I recovered several thousand dollars with a minimal amount of work on my part. Moreover, I have shared my victory with some of my neighbors, who have filed claims and been approved within a week. While I was able to recover several thousand dollars, my neighbors collectively may recover more than one million dollars!!

Thanks again for providing a lot of great information and motivation on your site. I am not a lawyer and do not have any legal training, and I hope this story will motivate others to stick up for their rights against large companies.

Here is the letter he wrote to his insurance company that got results:

Dear Mr. [Adjuster],

I have received by electronic mail your letter dated [ ] (the "Letter") denying coverage for the above referenced claim that I filed (the "Claim") and present the following observations for your consideration:

1.) As you mention in the Letter, my insurance policy #[ ] underwritten by [underwriter] for the policy period of [ ] to [ ] (the "Policy") is an "all-risks" policy. The Policy includes coverage for unit assessments resulting from an occurrence that would have been covered under the Policy to property collective owned by all unit Owners. Further, the Policy includes specific coverage for "Rebuilding to Code" after a covered loss.

2.) As we discussed upon your review of the condominium offering plan, the balconies and railings are residential limited common elements that are owned by all residential unit owners, which would satisfy the requirements for the unit assessments coverage.

3.) In the Letter you do not disagree with the statement of fact that the New York City Department of Buildings ("DOB") required the condominium to rebuild all of the balconies to the 2008 New York City Building Code (the "2008 Code") which superseded the 1968 New York City Building Code that had been in effect when the condominium was designed and constructed.

4.) According to the June 7, 2011 letter from [Architect], the independent architectural firm hired by the condominium to repair the balconies, the DOB required that all of the balconies be rebuilt to the new 2008 code as mandated by the change in occupancy status resulting from the DOB's partial vacate order that was issued after an incident of glass breakage of unknown cause on the western fa?ade of the condominium on July 1, 2009.

5.) You cited in the Letter certain exclusions to the Policy with the headings of "gradual or sudden loss" and "faulty planning, construction, or maintenance" thereby implying that these exclusions apply to the Claim. You further state in the Letter that the DOB's requirement to rebuild to the 2008 code "It appears this was due to possible faulty construction and deficiencies". However, this statement contradicts the statements made by [Architect] in their July 2009 report. Additionally, you fail to provide definitive proof to demonstrate that any of these exclusions in the Policy apply to the Claim. The use of the terms "appears" and "possible" further support my assertion that you do not have definitive proof that the cited exclusions apply to the Claim.

6.) New York law recognizes that an essential purpose of all-risks insurance is to provide coverage when the exact cause of the loss cannot be established, as in the case of my Claim. "All risk insurance arose for the very purpose of protecting the insured in those cases where difficulties of logical explanation or some mystery surround the loss or damage to property" Formosa Plastics v Sturge, 684 FSupp 359, 366 (SDNY 1987).

7.) As required by New York law, I have established that an all-risks policy was in place and the loss was fortuitous and occurred on the covered property by providing documentation (as summarized above) in the form of condominium account statements and letters from the condominium board of managers and FSA, the design architect hired by the condominium.

8.) New York law further explains that the insurer has the burden to prove, both as a matter of fact and as a matter of policy interpretation, that the loss was caused by something clearly excluded in the Policy. In Great Northern Ins. Co. v Dayco Corp., 637 FSupp 765, 777 (SDNY 1986) the court stated: "Once the insured has established a prima facie case, the insurer must prove that the claimed loss is excluded from coverage under the policy; the insurer must show that the loss was proximately caused by the excluded peril. The burden on the insurer is especially difficult because the exclusions will be given the interpretation which is most beneficial to the insured." Similarly Simplexdiam Inc. v. Brockbank, 283 AD2d 34, 39 (1st Dept. 2001) stated, "Under an all risks policy an insured need not prove the cause of the loss and is not bound to go further and prove the exact nature of the accident or casualty which, in fact, occasioned the loss." See also Congregation Beth Torah v. Graphic Arts Mutual Ins. Co., 739 NYS2d 454, 455 (2d Dept. 2002) which states that "defendant [insurer] failed to meet its burden of proving that the loss was within the scope of the policy exclusions it sought to impose"
Based on the observations and applicable legal precedents cited above, I kindly ask that you reconsider and approve my Claim or otherwise provide definitive proof that an exclusion to the Policy applies to the Claim, as applicable under New York law. Please contact me by [ ] with your response to this letter.
